Terms and Conditions for Vendors

Punk Rock Flea Market is both a place to buy and sell things and a community-built event. Every vendor, artist, collector, musician, volunteer, and customer who comes to PRFM helps shape the experience.

These guidelines are intended to create a marketplace that’s safe, fair, welcoming, and enjoyable for everyone. We ask all vendors to do their part by respecting one another, communicating in good faith, and contributing to our creative and independent spirit.

The following terms and conditions define the agreement between each VENDOR and PUNK ROCK FLEA MARKET, the host. Participating in the PRFM is contingent on agreeing to and adhering to these rules. Any vendor's appearance at PUNK ROCK FLEA MARKET denotes acceptance of all terms and conditions.


1. LAWS, RULES AND REGULATIONS

Vendors may not sell any item which violates federal, state, or local laws.

When at the venue all pertinent laws, ordinances, fire codes and regulations pertaining to health, fire prevention and public safety shall be strictly obeyed.

Vendors are responsible for obtaining any licenses, permits, or tax registrations required for their business.

Vendors are responsible for ensuring all merchandise complies with federal, state, and local law.

Counterfeit merchandise, stolen property, or items that infringe on copyrights or trademarks are prohibited.

Products subject to age restrictions (tobacco, cannabis, alcohol, etc.) must comply with all applicable laws.

Food vendors must comply with all applicable health department regulations and permit requirements.

The VENDOR agrees to keep all merchandise, chairs and other equipment within the marked boundaries of their booth. FIRE LANES MUST BE KEPT CLEAR. Merchandise, structures and vehicles will be moved if blocking aisles or fire lanes.

 

2. CONTENT OF BOOTH

Punk Rock Flea Market encourages diverse vendors selling the widest variety of goods. We’re very open to new ideas and unique merchandise. In general we seek the participation of tiny locally owned businesses and avoid corporate entities and multi-level marketing.
Culturally insensitive items are NOT permitted at Punk Rock Flea Market. This includes, but is not limited to, items that are racist, misogynist, homophobic, transphobic, ableist, discriminatory against any religions or other groups.

Items not intended for family viewing – such as pornographic material - are allowed but must be displayed where young children cannot view them.

Food and drink items can be sold with management approval.

Punk Rock Flea Market management reserves the right to approve the contents and character of all displays and merchandise and reserves the right to prohibit or expel any merchandise that is out of keeping with the character of the event.

3. VENDOR CONDUCT

We expect Punk Rock Flea Market vendors to treat one another, our staff, and our guests with respect.

When disagreements or problems arise, we ask that vendors handle them with patience and good faith. Harassment, intimidation, threats, abusive language, discriminatory behavior, or creating a hostile environment toward other vendors, customers, volunteers, or staff will not be tolerated. Please be a good neighbor. Help keep aisles clear, keep noise at a reasonable level, clean up after yourself, and share space fairly.

PRFM staff may ask vendors to modify behavior that negatively affects the event or the people around them. Vendors who refuse to cooperate, repeatedly disrupt the event, or whose conduct is inconsistent with the spirit of the Punk Rock Flea Market may be asked to leave without refund.

4. SPACE ASSIGNMENTS

Punk Rock Flea Market staff will use our best efforts to locate the VENDOR’S booth in an acceptable area and accommodate for a VENDOR’s needs. Notwithstanding the above, Punk Rock Flea Market reserves the right to change VENDOR booth location assignments at any time, as it may deem necessary. This will be done in communication with the VENDOR.

Individuals can team up to rent a space, as long as their combined items fit in the assigned booth space.

5. PAYMENT/CANCELLATION POLICY
To reserve a VENDOR space, full payment must be made by stated deadlines. No spaces are considered reserved without payment. Once your payment is processed, we will send you a confirmation email outlining all the event details.
Any vendor spaces not yet reserved on the morning of the event will be available, and payment will be picked up by a Punk Rock Flea Market representative during the event. Full payment is required and will not be adjusted for less set up time. 
Vendors are required to give 7-day advance notice of cancellation for a vendor space in order to receive a full refund for fees paid. If a vendor is unable to give 7-day advance notice of cancellation, they may be responsible for payment of the booth rent. Fees will be returned upon or soon after cancellation notice is received.
VENDORS are not to sell or otherwise re-assign their reserved space

6. ANIMALS
Dogs and other pets are welcome so long as the pet is social and friendly. If you bring a pet to the Punk Rock Flea Market, you assume all responsibility for the pet and any damage it may cause. Please clean up after your pet.
Service animals are always welcome.

7. ACCOMMODATION FOR DIFFERENT ABILITIES

We intend to make every aspect of the event accessible and ensure equal participation by all guests. If any aspect of the Punk Rock Flea Market grounds or arrangements leads to difficulty, we ask VENDORS to communicate their needs quickly and clearly, and every effort will be made to give vendors and guests with limited abilities the opportunity to participate and enjoy.


8. VENDOR assumes all responsibility for compliance with all these terms. Punk Rock Flea Market reserves the right to restrict and evict any seller, without refund, for non-compliance with rules & regulations as stated, for any violations of the above activities, or for a method of operation that distracts from the integrity of the event.
9. PRFM staff are responsible for interpreting these guidelines, and resolving issues that arise during the event. Their decisions are final.
